If I download something with utorrent and I lock the device the download is stopped and overdrive also.
How could I fix these?

I'm assuming by Lock you mean it goes into standby (Sleep)? It's a PC, so it will go into a suspended state when you put the computer into Standby/Sleep. Apps won't run in the background, nor will things continue to download.
When you say "lock" you need to clarify what you mean. If you are just locking the machine so it requires a password to log back in then you should be ok, but there are some things you need to check.
Surface isn't setup to be an "always on" device like a regular PC. You'd have to disable all it's battery saving type functionality.
Have a look at the advanced settings in your power options screen.
